Building in Romania - Constructions and Design Conditions

How  to obtain a  Building  Permit in Romania.  What  Professionals are involved  during  both design and construction phases.

Urbanism Certificate (Certificatul de Urbanism)

By Application on City Hall

Legal term to be delivered: 30 days

Usually, for most cities the legal term is not respected, but not tacit acceptance can be used.

Public Authority Document to detail the general conditions to build to a specific site.

- Technical Status

Withdrawals and Alignment Requirements

POT (Procent de ocupare) Occupancy percent of the site area

CUT (Coefficient de utilizare) Land Utilization Coefficient as rapport between total built areas and land area

Height level, expressed both as number of built levels over the ground and as metric height

Lists of Avization and Authorizations that should be obtained before the Building Permit Application.

PUZ* or PUD** might be required as preliminary stage of Building Permit Application.

Preliminary Avizations and Authorizations

PUZ or PUD Site Avizations:

- Electrical Company permit

- Gas Company permit

- Water and Canalization Company Permit

- Phone Company Permit

- National Road Agency Permit

- Secret Service Permit, Army Permit – just for some sites

- Etc

Site Avizations:

- Electrical Company permit

- Gas Company permit

- Water and Canalization Company Permit

- Phone Company Permit

- Secret Service Permit, Army Permit – just for some sites

Etc

Building Design Authorizations (Building Design Project for Building permit is required):

- Fire Department Authorization

- Civil Defense Authorization

- State Construction Inspectorate Permit

- Environmental Agency Authorization or Accord

- Sanitary Agency Authorization

- Historical Sites and Monuments by the Ministry of Culture Authorization

- Etc

Other Acceptances may occur, as neighbors acceptances for some works, Legal Statements by the owner, etc

The Avizations may last 15-30 days. Others might condition some Avizations, such the Environmental Agency Accord that first asks for Water Agency Avization.

Unique Offices for Avization may be functional with the City Hall. Nevertheless, some Avizations might be required in advance.

PUD or PUZ

Detailed Urbanism Plan (Master plan) or Zone Urbanism Plan (Master Plan)

Approved by:

- Technical Comity with the City Hall Approval – no legal term -

- Local Council Vote – no legal term –

Both PUD and PUZ are Local Authorities Documents after approvals.

PUZ and PUD include a set of Urban Regulations for the Zone or the Particular Site. Some Counties require new Urban Certificate after the PUZ or PUD approval, containing the new Building Conditions according to the new approved Projects.

PUZ and PUD are design exclusively by Architects or Engineers registered with RUR (Romanian Urbanists Register).

PUD and PUZ are Urbanism Plans that might be required by the Urban Certificate if:

- The land has no Local Urbanism Regulations to be applied for

- The land is outside the Intravilan*** Area (Extravilan****)

- The Application for the Urban Certificate requires different POT, CUT, or Height of the Building, different Withdrawals or Alignments, different functionality for the building etc

- Previous Construction Interdictions are functional for the specific land approved by other PUZ, by the PUG***** or by specifications within the land plots for constructions by the Local Urbanism Regulations******

There is no guaranty that the PUZ or PUD should be applied as they are intended to be. Technical Comity or Local Council with the City Hall might change partially or totally the technical dates with the PUZ or PUD, or even deny the PUZ or PUD.

AC - Building Permit (Construction Permit)

Building Permit Applications with the City Hall

30 days term since the Application Annexes are complete (Preliminary Avizations, Permits, property Title, Cadastre in tabulation, Building Design Project, etc)

City Hall and the State Construction Inspectorate should be notified about Construction Start Date.

The Building Permit (Construction Permit – Autorizatia de Construire) gives the right to build respecting the Technical Project (Building Design and Specifications Approved).

1 Year term to start the works. Another 6 months prolongation applications for this term are possible. Over this period, a new building Permit should be applied for.

1 up to 3 years term to finish de works (according with the Building Permit Term). 1 Year prolongation application can be done. Over this period, a new Building Permit should be applied for.

Building Permit project

And Building Technical Project (containing both technical Drawings and Specifications)

Architectural and Engineering Designs, such as Technical Project can be design exclusively by teams leaded by Registered Architects with OAR (Order of Architects of Romania – Ordinul Arhitectilor din Romania) and listed as „licensed to sign” in the National Table (Panel) of Architects.

All Engineers should be licensed by Construction Technical Universities attested by the Romanian Government. Exclusively the licensed engineers of a specific Faculty can practice each specialization.

There is no building importance as low as nonprofessionals to be allowed to design in Romania.

The client (Beneficiary) should order the Project Verifications according with Romanian Design Exigencies:

A- Structural Stability

Af- Geotechnical Safety

B- Public Safety

C- Fire Safety

D- Public Health Safety

E- Thermal and Water Insulations Conformity, Energy Economy Conformity

F- Environmental Safety

I- HVAC, Plumbing, Sanitation, Electricity Design Conformity with the Design Norms and Laws

Project Verifiers are Architects and Engineers attested by the Ministry of Constructions and Public Works to verify technical projects. They are responsible in the name of the Client (beneficiary) with the conformity of the Design with the Building Codes.

Execution Phase

Inspections:

- City Halls inspections

- State Construction Inspectorate – for specific Determinative Construction Phases *******

- Architect and Engineers from Design Team Inspections as part of specific Determinative Construction Phases Control Program or as right according with Author’s Rights Laws

- Labor Agency with the Ministry of Labor

- All the Companies or State Agencies that are part of the Avization Process

The client (beneficiary) should hire a Site Director (Diriginte de Santier) attested with the Romanian Ministry of Constructions and Public works.

The Site Director is the technical representative of the Beneficiary and his role is to check the Construction Quality according with Romania Construction Laws and the conformity with the technical Project and the Building Permit.

Design Changes during Execution Phases

Only small design changes can be done during Execution Phases.

Contactors, Constructors, Architects or Engineers hired by the Constructors are not allowed to make any changes to the Building Design.

The Client or the Beneficiary is not allowed to make any changes to the Building Design.

Not even the Site Director is allowed to make changes to the Design. His main role is actually to supervise the fully conformity of the works with the design.

Only by special disposal of architects and engineers that designed the building.

On Site Disposals should be approved by the Project Verifiers that verified the project.
